about them.\u00a0 Instead we hear about a financial advisor like Bernie Madoff.<\/p>\n<p>Fortunately those are few and far between.\u00a0 But don\u2019t just assume you are safe.\u00a0 According to the Wall Street Journal, about<strong><em>\u00a0one in eight <\/em><\/strong>brokers or advisors has red flags\u00a0on their regulatory filings.\u00a0 These red flags can include customer complaints or other problems that you need to know about.<\/p>\n<p>In addition:<\/p>\n<ul>\n<li>An estimated 70,000 advisors have at least one disclosure<\/li>\n<li>Nearly 3,000 advisors have at least five disclosures<\/li>\n<\/ul>\n<p>What are these disclosures?<\/p>\n<ul>\n<li>Customer complaints<\/li>\n<li>Bankruptcies<\/li>\n<li>Criminal charges<\/li>\n<li>Regulatory actions or terminations<\/li>\n<\/ul>\n<p>If you\u2019re like most people and don\u2019t know where or how to check, you may be unknowingly working with one of these advisors.\u00a0\u00a0 Not good!<\/p>\n<div class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Fortunately, the <strong><span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/brokercheck.finra.org\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Financial Industry Regulatory Authority<\/a><\/span><\/strong>\u00a0(FINRA) provides an easy way to check the disciplinary records and history of a financial advisor or\u00a0broker.\u00a0 You only need to do one quick search to find your advisor and their firm to get the facts.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Using_Brokercheckorg\"><\/span><strong>Using Brokercheck.org<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Go to BrokerCheck.org and fill in the information to look up the firm or individual.\u00a0 The results are presented in a user-friendly graphical timeline so you can see information on:<\/p>\n<ul>\n<li>The individual\u2019s employment status and history<\/li>\n<li>industry registrations<\/li>\n<li>any \u201creportable events\u201d such as customer disputes or disciplinary actions<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Good_but_not_perfect\"><\/span><strong>Good, but not perfect<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Unfortunately, this is a good resource, but it\u2019s not perfect.<\/p>\n<ul>\n<li>First, the information on BrokerCheck\u00a0is largely self-reported.<\/li>\n<li>Second, it is possible that negative disclosure events may have been removed (\u2018expunged\u2019) from an individual\u2019s record.<\/li>\n<\/ul>\n<p>But even with these limitations, you can\u2019t afford to miss critical information, so don\u2019t let that deter you.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"What_to_Look_For\"><\/span><strong>What to Look For<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li><strong>Disclosure Events<\/strong>\u00a0\u2013 This is the big one.\u00a0 Look for regulatory events, customer disputes, terminations, judgement\/liens, and bankruptcies. \u00a0Any of these are of considerable concern.<\/li>\n<\/ul>\n<ul>\n<li><strong>Work History\u00a0<\/strong>\u2013 Problem individuals often change firms frequently.\u00a0 If you see this on an advisor\u2019s record, this can be a sign of problems.<\/li>\n<\/ul>\n<ul>\n<li><strong>Required to Pay Restitution or Fines<\/strong>\u00a0\u2013 If the individual has paid fines or restitution to a client, this is a definite red flag.\u00a0 You should consider switching advisors\u2014it\u2019s just not worth the risk.<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Other_Sources_of_Information\"><\/span><strong>Other Sources of Information<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Fortunately there are other sources of information.\u00a0 There are independent financial advisor rating agencies, such as the <strong><span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"http:\/\/www.paladinregistry.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Paladin Registry<\/a><\/span><\/strong>, which provide even more information on the business practices of advisors, along with information on their compliance records.<\/p>\n<p>You can also check with state agencies for further information.\u00a0 There\u2019s no centralized source, but contact information for each state\u2019s regulatory agency can be found on the North American Securities Administrators Association\u00a0<strong><span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"http:\/\/www.nasaa.org\/about-us\/contact-us\/contact-your-regulator\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">website<\/a><\/span><\/strong>.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Dont_Risk_It\"><\/span><strong>Don\u2019t Risk It!<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>When your life savings is at stake, you cannot afford to give someone the benefit of the doubt.<\/p>\n<p>When you\u2019re looking to hire or switch advisors, always check before making the move.\u00a0 Then, even if you have an advisor and things are going well, always plan ongoing checks.\u00a0 It\u2019s a good idea to have an \u201cannual checkup\u201d that includes a broker check at least once per year.<\/p>\n<p>In this case, it\u2019s always better to be safe than sorry.<strong>\u00a0<\/strong><\/p>\n<p><em><strong>Jeanne Klimowski
