financial advisors are required to act ethically\u2014that is, to always act in your best interest, not theirs.\u00a0 But did you know that the law doesn\u2019t require all advisors to do that?\u00a0 class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Hiring a financial advisor is quite different than hiring any other professional.\u00a0 You can\u2019t just look around and pick one you like best.\u00a0 For one thing, there\u2019s no state organization (like the state bar for lawyers) that requires a person to earn the status.\u00a0 Believe it or not, there\u2019s no mandatory education, experience or exhaustive testing requirements. Instead, really anyone can use the title \u201cfinancial advisor\u201d.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Real_Advice_or_Sales\"><\/span><span style=\"color: #000000;\"><strong>Real Advice or Sales?<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Compounding the problem, there are two different legal standards to which advisors are held.<\/p>\n<p>The first one is the <strong>fiduciary standard<\/strong>.\u00a0 Advisors who fall under this category are legally required to put your interests first.\u00a0 <strong><span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"http:\/\/blog.paladinregistry.com\/advisors-2\/should-i-trust-a-fiduciary-financial-advisor\/\" target=\"_blank\">These advisors must act as a \u201ctrue\u201d advisor<\/a><\/span><\/strong>. This person needs to learn about you, your goals, and your responsibilities and then help you put a plan in place to achieve the best outcome.\u00a0 If they don\u2019t do this, you have legal recourse.\u00a0 These types of advisors are known as \u201cFiduciaries\u201d.<\/p>\n<p>The other legal standard is called the <strong>suitability standard<\/strong>.\u00a0 A financial advisor who falls under this category is not legally required to act in your best interest.\u00a0 Instead, they are simply required to make \u201csuitable\u201d recommendations for you. \u00a0So if they learn about you and your goals, they can recommend a product that pays them a higher commission, as long as it was generally suitable.\u00a0 You end up spending far more than you needed to because of the commission, but they didn\u2019t do anything wrong.\u00a0 Their duty of loyalty actually lies with the company they work for, not to you.\u00a0 These people are really product salespeople.<\/p>\n<p>Of course, there are many honest and knowledgeable salespeople out there, but the companies they work for will want (and often require them) them to sell certain products. \u00a0This creates an ethical problem\u2014these advisors may end up giving you \u201cconflicted advice\u201d.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Does_it_Really_Make_a_Difference\"><\/span><span style=\"color: #000000;\"><strong>Does it Really Make a Difference?<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Does hiring one type over the other really make much of a difference?\u00a0 A White House Council of Economic Advisers (CEA) report states that \u201cconflicted advice\u201d about investments is estimated to cost Americans <strong>$17 billion per year<\/strong>.\u00a0 That\u2019s right \u2013 that\u2019s <strong>per year<\/strong>.<\/p>\n<p>As you can see, you are far better off to avoid these types and instead look for a fiduciary only.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Finding_the_True_Advisors\"><\/span><span style=\"color: #000000;\"><strong>Finding the True Advisors<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>So, the true advisors are fiduciaries.\u00a0 But determining who is a fiduciary and who is not can be quite difficult.\u00a0\u00a0 Sadly, there are many creative titles out there to keep everyone confused.\u00a0 Making it worse, even some fiduciaries may be \u201cdual registered\u201d so they potentially can also act as salespersons part of the time.<\/p>\n<p>Fortunately, there\u2019s a few steps you can take to cut through the confusion.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Certification_Agencies\"><\/span><span style=\"color: #000000;\">Certification Agencies<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>There are some certification agencies that require members to adhere to a code of ethics.\u00a0 The code of ethics will usually require them to put your interests first.\u00a0 And, these certifications require significant study and testing to achieve.\u00a0 Good certifications include CFA\u00ae, CPA\u00ae, and CFP\u00ae. But, there are some designations that advisors can get that simply make them look more knowledgeable than they really are. \u00a0These may just require payment of a fee or taking one course.
