Odds are you would be upset, but paying too much for your car has no effect on your driving it for years to come. Paying too much for your 401k plan, however, is like a leak in your gas tank; the ultimate effect is that neither is going to take you as far as you need to go.<\/p>\n<p>Regrettably, there have been many leaky plans since the inception of the 401k back in the 1980s, but not until 2012 did 401k service providers have a legal responsibility to disclose all of their fees and compensation. While <i>leak<\/i> implies small, <strong><span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"http:\/\/www.dol.gov\/ebsa\/publications\/401k_employee.html\" target=\"_blank\" rel=\"nofollow\">according to the DOL,<\/a><\/span><\/strong> 1% in unnecessary fees over an average 35-year working career could reduce a participant\u2019s account balance at retirement by 28%! <a href=\"http:\/\/www.dol.gov\/ebsa\/publications\/401(k)_employee.html\"><br \/>\n<\/a><\/p>\n<p>The fee disclosure rules enacted in 2012, which were intended to plug the leak, <strong><span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"http:\/\/www.prudentchampion.com\/wp-content\/uploads\/2013\/12\/WCW-DECEMBER-Mensack.pdf\" target=\"_blank\" rel=\"nofollow\">are flawed<\/a><\/span><\/strong>. Reminiscent of the infamous \u201cit depends on what the definition of the word \u2018is\u2019 is,\u201d one flaw depends on what the definition of \u201cdisclosure\u201d is.\u00a0 Some service providers apply the Einstein theory of disclosure, while others use the Rube Goldberg theory.<\/p>\n<p>Einstein\u2019s theory is based on his belief that, \u201c401k Fee disclosures should be made as simple as possible, but not simpler.\u201d\u00a0 His actual quote was \u201c<em>Everything<\/em> should be made as simple as possible, but not simpler\u201d.<\/p>\n<p>For example, if a service provider applying the Einstein theory needed to disclose compensation amounting to $496,000, the disclosure would read: We receive $496,000 in compensation.<\/p>\n<p>The Rube Goldberg theory is named after <strong><span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"http:\/\/www.rubegoldberg.com\/home\" target=\"_blank\" rel=\"nofollow\">Rube Goldberg<\/a><\/span><\/strong>, a cartoonist well-known for his drawings of overly complicated mechanisms used to accomplish very simplistic tasks. These mechanisms were known as Rube Goldberg Machines, and if you\u2019ve ever played the game Mousetrap, you\u2019ve got the idea.<\/p>\n<p>Applying the Rube Goldberg theory to the same $496,000 disclosure, it would read:<\/p>\n<p>\u201cIn 2011, when viewed in relation to total MSSB client assets of in excess of $1.6 trillion, the payment made by each such service provider\u2026equaled an amount of not more than 31\/10,000 of one basis point (otherwise expressed, 31\/1,000,000 of one percent).\u00a0 We do not believe that such payments were made in connection with retirement plan business specifically, and were certainly not made in connection with any particular retirement plan, but, for perspective, the amount of retirement plan assets included in the total MSSB client asset number set forth above is approximately $112 billion.\u201d <a href=\"http:\/\/www.prudentchampion.com\/wp-content\/uploads\/2013\/11\/MS-Nationwide-408b2-discl.pdf\" target=\"_blank\" rel=\"nofollow\">\u00a0<strong><span style=\"color: #0000ff;\">See page 7 of MSSB&#8217;s Qualified Retirement Plan Disclosure Document<\/span><\/strong><\/a>.<\/p>\n<p>The Department of Labor recognizes the Rube Goldberg theory effect writing, <strong><a href=\"http:\/\/webapps.dol.gov\/FederalRegister\/HtmlDisplay.aspx?DocId=27415&amp;AgencyId=8&amp;DocumentType=1\" target=\"_blank\" rel=\"nofollow\"><span style=\"color: #0000ff;\">\u201cAnecdotal evidence suggests that small plan fiduciaries in particular often have difficulty obtaining required information in an <i>understandable format<\/i>, because <i>such plans lack<\/i> the bargaining power and <i>specialized expertise<\/i> possessed by large plan fiduciaries.&#8221;<\/span> <\/a><\/strong>\u00a0<a href=\"http:\/\/webapps.dol.gov\/FederalRegister\/HtmlDisplay.aspx?DocId=27415&amp;AgencyId=8&amp;DocumentType=1\"><br \/>\n<\/a><\/p>\n<p>In order to prudently remedy this flaw, one might expect the DOL proposal to prohibit the use of the Rube Goldberg theory, and mandate that all disclosures be as simple as possible, but not simpler. Absurdly, the DOL proposed a <i>guide<\/i>, because \u201ca guide would help small plan fiduciaries<b> <\/b>locate important information disclosed in multiple, often long and <i>complex documents<\/i>\u2026\u201d<\/p>\n<p>In a second act of folly, the guide is to be written by service providers, even those adhering to the Rube Goldberg theory! DOL\u2019s reasoning is that service providers \u201care in the best position to identify the location of information that otherwise <i>may be difficult for a responsible plan fiduciary to find in multiple, highly technical or lengthy disclosure materials<\/i>.\u201d<\/p>\n<p>The DOL proposal amounts to a Rube Goldberg remedy to solve a Rube Goldberg flaw! As a result, at retirement some of you are going to find that your 401k isn\u2019t going to take you as far as you need to go.<\/p>\n<p>Share this article with your employer, or better yet, your Senators and Congressional Representative. If you don\u2019t motivate them, no one else will and it\u2019s your<strong><span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"http:\/\/www.paladinregistry.com\/retirement\/retirement-in-america\" target=\"_blank\"> retirement income<\/a><\/span><\/strong> security that is at risk!<\/p>\n","protected":false},"excerpt":{"rendered":"<p>How would you feel if after buying a new car you discovered you paid too much?
