{"id":3136,"date":"2014-02-12T06:29:02","date_gmt":"2014-02-12T14:29:02","guid":{"rendered":"http:\/\/staging-prblog.paladinregistry.com\/blog\/?p=3136"},"modified":"2014-02-10T15:29:25","modified_gmt":"2014-02-10T23:29:25","slug":"retaliating-standardpoors-sp-matters","status":"publish","type":"post","link":"https:\/\/www.paladinregistry.com\/blog\/wall-street\/retaliating-standardpoors-sp-matters\/","title":{"rendered":"Why Retaliating Against Standard &#038; Poor&#8217;s (S&#038;P) Matters"},"content":{"rendered":"<p><a href=\"https:\/\/www.paladinregistry.com\/blog\/wp-content\/uploads\/2014\/02\/SP.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"168\" class=\"alignleft size-medium wp-image-3141\" alt=\"S&amp;P\" src=\"https:\/\/www.paladinregistry.com\/blog\/wp-content\/uploads\/2014\/02\/SP-300x168.jpg\" srcset=\"https:\/\/www.paladinregistry.com\/blog\/wp-content\/uploads\/2014\/02\/SP-300x168.jpg 300w, https:\/\/www.paladinregistry.com\/blog\/wp-content\/uploads\/2014\/02\/SP.jpg 600w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a>In 2011, <a href=\"http:\/\/www.standardandpoors.com\/en_US\/web\/guest\/home\" target=\"_blank\">Standard &amp; Poor\u2019s <\/a>(S&amp;P) downgraded the bond rating of the US government from AAA to AA+.\u00a0 The other two major bond rating agencies, Moody\u2019s and Fitch, continued to maintain their AAA ratings on the U.S. government.<\/p>\n<p>In February of 2013, in an action ostensibly unrelated to the downgrade, the Justice Department sued S&amp;P alleging that the company had defrauded investors by giving their highest rating to mortgage bonds that did not deserve them.<\/p>\n<p>Problematically, Moody\u2019s and Fitch had applied their highest rating to many of the very same mortgage bond deals in question and yet they were not sued by the Justice Department.\u00a0 Because the U.S. government has only sued the one firm who has downgraded it, notwithstanding its two rivals engaged in substantially identical behavior, many people have suspected that the government was suing S&amp;P as retaliation for expressing its negative rating opinion.<\/p>\n<p>On Tuesday, January 21, additional information was filed in the case that supports the allegation that the government has singled out Standard &amp; Poor&#8217;s for behavior common to all three rating agencies as retaliation against S&amp;P for its downgrade.\u00a0 According to documents filed in the case, the CEO of S&amp;P stated that days after the downgrade, U.S. Treasury Secretary Tim Geithner called him and angrily threatened that S&amp;P\u2019s actions could not go without a \u2018response\u2019 from the government.\u00a0 Shortly thereafter the government filed its suit against S&amp;P.\u00a0 (Mr. Geithner in a few weeks will become President of the investment bank Warburg Pincus.)<\/p>\n<p>The disparity of treatment between S&amp;P and its rivals is glaring and the allegation of retaliation is certainly plausible.\u00a0 But why should anyone care about this disparity of treatment?<\/p>\n<p>In the opinion of <a href=\"http:\/\/www.paladinregistry.com\/terminate\/find-securities-lawyers\" target=\"_blank\">many attorneys who represent investors<\/a>, Wall Street, for a variety of reasons, including its wealth, control of the funding operations of governments at all levels, its day in and day out presence as a litigant in courts, and its constant advocacy of its interests with legislators, has succeeded in systemically corrupting our system of jurisprudence in its favor.<\/p>\n<p>To wit, law suits against Wall Street ordinarily cannot be brought in court, but must be brought to <a href=\"https:\/\/www.paladinregistry.com\/blog\/wall-street\/are-finra-arbitration-panels-fair\/\" target=\"_blank\">arbitration proceedings supervised by FINRA, Wall Street\u2019s trade organization.<\/a>\u00a0 Wall Street wins about 60% of these cases, and when plaintiffs do win, they are compensated on average at less than 50 cents on the dollar for their losses.<\/p>\n<p>If the allegation of retaliation is true, the Justice Department seems to accept the fact that our system of jurisprudence with respect to securities cases is an irredeemably corrupt system that exists to serve the interests of those who control it.\u00a0 Because S&amp;P is hardly an entity that most people identify with, they also rest assured that there will be no public outcry for any injustice done to S&amp;P.\u00a0 Unfortunately, when ordinary investors suffer injustice in this system there is also no public outcry; their cases are not newsworthy and they suffer in comparative silence.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In 2011, Standard &amp; Poor\u2019s (S&amp;P) downgraded the bond rating of the US government from AAA to AA+.\u00a0 The other two major bond rating agencies, Moody\u2019s and Fitch, continued to maintain their AAA ratings on the U.S. government.
